Terms of Service – circled.club (Version 2.0)

1. Scope and Responsibility

These Terms govern the use of circled.club, an independent, community-driven social platform operated by high-bau GmbH, Munich, Germany.

2. Eligibility and Use

1. Use is permitted for individuals aged 18 years or older.
2. By registering, members accept these Terms in their current version.
3. circled.club must only be used for lawful purposes aligned with the platform’s objectives — social, educational, cultural, or sustainable collaboration.
4. Activities involving harassment, manipulation, surveillance, misinformation, or exploitation of others are prohibited.
5. Additional or specific Terms may apply to certain Spaces, Circles, or Products. Such Terms complement, but do not override, these general Terms.

3. Memberships and Services

1. Standard Membership (free): Access to public Spaces; ability to read, post, and comment.
2. Plus Membership (paid): Create and manage personal Circles; extended organizational and publishing tools.
3. Nominated Membership (free by invitation): For individuals, initiatives, or organizations with verified social impact; extended publishing rights (Blog, News, etc.).
4. Pro / Partner Membership (paid): For professionals, businesses, and ecosystem partners with commercial or educational offerings (Products, Services, Courses).
5. The scope and availability of functions may change through technical development, moderation policy, or security measures.

4. Data Protection

circled.club processes personal data exclusively in accordance with its Privacy Policy and the GDPR.

No personal data is transferred to third parties for advertising, profiling, or tracking purposes.

5. Content and Responsibility

1. Members are solely responsible for the content they publish.
2. Content violating applicable law or the core values of circled.club — including, but not limited to, discriminatory, violent, pornographic, defamatory, or copyright-infringing material — is prohibited.
3. circled.club reserves the right to remove such content or restrict access without prior notice.
4. Legitimate self-promotion of a member’s own projects, products, or services is allowed if appropriately categorized (e.g., “Offering,” “Funding,” “Event”) and aligned with the platform’s goals.
5. circled.club may reassign or move content to suitable Spaces if posted in the wrong category.
6. Repeated or severe violations may lead to suspension or termination of accounts.

6. Intellectual Property

1. All rights to platform software, design, graphics, and text remain with circled.club or the respective rights holders.
2. By uploading content, members grant circled.club a non-exclusive, royalty-free right to display and distribute the material within the platform’s ecosystem.
3. External sharing of member content requires explicit consent from the author, unless covered under open-license terms.

7. Availability and Liability

1. circled.club is operated with reasonable diligence but cannot guarantee uninterrupted availability.
2. Maintenance or security work may cause temporary restrictions.
3. circled.club is not liable for data loss, technical failures, or consequential damages unless caused intentionally or by gross negligence.
4. circled.club assumes no responsibility for third-party content or external links.

8. Termination of Membership

1. Members may delete their accounts at any time or request deletion via the contact form.
2. circled.club may suspend or delete accounts for misuse, repeated violations, or security concerns.

9. Changes to the Terms

circled.club may update these Terms when technical, legal, or community developments require it.

Members will be notified in advance. Continued use of the platform after changes constitutes acceptance of the new version.

Archived versions remain publicly available for transparency.

10. Governing Law and Jurisdiction

German law applies.

Place of jurisdiction is Munich, Germany.

11. Language

The legally binding version of these Terms is German.
